Terms of Service

By accessing or using Publio AI (“the Service”), operated by Publio AI (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you represent that you have the legal capacity to enter into a binding agreement and that you accept these Terms on behalf of yourself or the entity you represent.

Publio AI is an AI-powered social media management platform. The Service analyzes your website and brand presence, generates platform-specific content using artificial intelligence, and publishes that content to connected social media platforms including Instagram, TikTok, Reddit, and Facebook.

Core features of the Service include brand voice analysis, AI content generation, multi-platform scheduling and publishing, performance analytics, and team collaboration tools. The specific features available to you depend on your subscription tier.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to affected users.

You must be at least 18 years of age to create an account and use the Service. By creating an account, you represent and warrant that you meet this age requirement.

You are responsible for maintaining the security of your account credentials, including your password and any API keys associated with your account. You must notify us immediately at support@publioai.com if you become aware of any unauthorized access to or use of your account.

Each account is intended for use by a single individual. You may not share your account credentials with others. If you need multiple users to access the Service, each person must have their own account. Team and agency plans provide collaboration features designed for multi-user workflows.

You are responsible for all activity that occurs under your account, whether or not you have authorized such activity.

The Service offers multiple subscription tiers, including a free plan and paid plans with additional features. Paid subscriptions are billed on a monthly or annual basis depending on the billing cycle you select at the time of purchase.

All payments are processed securely through Stripe. By subscribing to a paid plan, you authorize us to charge the payment method on file for the applicable subscription fees. You are responsible for providing accurate and current payment information.

Paid subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until that date.

We reserve the right to change our pricing at any time. If we change the pricing for your current plan, we will provide at least 30 days' advance notice via email before the new pricing takes effect. Continued use of the Service after the price change constitutes acceptance of the updated pricing.

We offer a 14-day free trial of paid features to new users. The free trial provides access to the features included in the selected paid plan for the duration of the trial period. No credit card is required to start a free trial.

At the end of the 14-day trial period, your account will automatically downgrade to the Free Sandbox plan unless you subscribe to a paid plan before the trial expires. You will not be charged automatically at the end of the trial.

We reserve the right to modify or discontinue the free trial offer at any time without prior notice. Free trial eligibility is limited to one trial per user.

We offer a 30-day money-back guarantee on your first paid subscription. If you are not satisfied with the Service within the first 30 days of your initial paid subscription, you may request a full refund by contacting us at support@publioai.com. Refund requests made within this 30-day window will be processed promptly with no questions asked.

After the initial 30-day period, subscription fees are non-refundable. This includes partial months of service, unused features, and account downgrade scenarios. If you cancel your subscription, you will retain access to paid features through the end of your current billing period but will not receive a prorated refund.

The Service uses artificial intelligence technology, powered by Anthropic's Claude, to generate social media content on your behalf. This includes text posts, captions, carousel scripts, reel storyboards, and other content formats.

While we strive to produce high-quality, on-brand content, AI-generated content may contain inaccuracies, errors, or material that does not align with your brand standards. You are solely responsible for reviewing, editing, and approving all AI-generated content before it is published to any social media platform.

We do not guarantee the accuracy, completeness, or suitability of any AI-generated content. The Service is designed to assist with content creation, not to replace human editorial judgment. You should verify all factual claims, ensure compliance with applicable laws and regulations, and confirm that content meets platform-specific guidelines before publishing.

You retain full ownership of all content generated through the Service using your brand data and inputs. We do not claim any intellectual property rights over content produced for your account.

You retain all ownership rights to the data and content you provide to the Service, including your website content, brand assets, media files, and any content you create or modify within the platform.

By using the Service, you grant us a limited license to access, process, and store your data solely for the purpose of providing and improving the Service. This license terminates when you delete your account or the applicable data.

We may use aggregated and anonymized data derived from your usage of the Service for purposes such as service improvement, analytics, and product development. This anonymized data will not identify you or your brand and cannot be reverse-engineered to do so.

Social media platform OAuth tokens and API credentials are stored using industry-standard encryption. We access your connected social media accounts only to the extent necessary to provide the features you have enabled, such as content publishing and analytics retrieval.

You agree to use the Service in compliance with all applicable laws and regulations and in accordance with these Terms. You may not use the Service to:

• Generate, distribute, or publish spam, unsolicited messages, or deceptive content
• Create or disseminate content that promotes hate speech, harassment, violence, or discrimination
• Produce, store, or distribute illegal content, including content that infringes on intellectual property rights
• Scrape, crawl, or use automated means to extract data from the Service beyond what is permitted by your subscription tier and our API documentation
• Interfere with or disrupt the Service, its servers, or the networks connected to the Service
• Attempt to gain unauthorized access to any part of the Service or other users' accounts
• Use the Service in any manner that violates the terms of service of connected social media platforms, including but not limited to Instagram, TikTok, Reddit, and Facebook

We reserve the right to suspend or terminate your account if we determine, at our sole discretion, that you have violated these acceptable use policies.

If you purchase a self-hosted deployment of Publio AI, you are granted a limited, non-exclusive, non-transferable license to install and run the software on your own infrastructure for the duration of your active subscription.

The self-hosted license is granted on a per-seat basis. Each individual who accesses the self-hosted instance must be covered by a valid seat license. You may not share, sublicense, or redistribute the software, its source code, Docker images, or any derivative works to third parties.

The self-hosted license does not grant you ownership of the software. All intellectual property rights in the software remain with Publio AI. You may not reverse-engineer, decompile, or modify the software except as expressly permitted by applicable law.

Either party may terminate this agreement at any time. You may terminate your account by canceling your subscription and deleting your account through the account settings page, or by contacting us at support@publioai.com.

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms, engage in fraudulent activity, or otherwise act in a manner that we determine is harmful to the Service or other users.

Upon termination, your right to access and use the Service ceases immediately. Your data will remain available for export for 30 days following termination. After this 30-day period, we will permanently delete your data from our systems, except where retention is required by law or legitimate business purposes such as fraud prevention.

To the maximum extent permitted by applicable law, Publio AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service.

Without limiting the foregoing, we are not liable for:

• The performance, reach, or engagement of content published through the Service
• Changes to social media platform APIs, policies, or algorithms that may affect the functionality of the Service
• Any third-party actions, including decisions by social media platforms to restrict, suspend, or terminate your social media accounts
• Inaccuracies, errors, or omissions in AI-generated content
• Service interruptions, downtime, or data loss caused by factors beyond our reasonable control

Our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

We reserve the right to update or modify these Terms at any time. For material changes, we will provide at least 30 days' advance notice by sending an email to the address associated with your account and by posting the updated Terms on this page with a revised “Last updated” date.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account as described in Section 11.
